What New York's lease rule and the Camillus rental share mean for a backup

New York Real Property Law section 235-b provides that in every written or oral residential lease the landlord is deemed to warrant that the premises and common areas are fit for human habitation and free of conditions dangerous, hazardous or detrimental to life, health or safety, except where the condition was caused by the misconduct of the tenant. Any agreement by a tenant waiving or modifying these rights is void as contrary to public policy.

The NY DFS guide states that a landlord does not insure a tenant's personal property, that by law the New York building owner insures the dwelling itself, and that if water damage ruins a renter's belongings the renter is not protected unless they buy renters insurance. It lists water damage from plumbing failure, appliances and other accidental discharges among the losses renters policies typically cover, and sewer and drain backup as coverage a renter may need to add.

Onondaga County WEP asks residents with sewage backing up to call 315-435-3157, which it answers at any time, every day, for properties connected to the public sewer inside the Consolidated Sanitary District. For City of Syracuse properties it directs the call to the City Department of Public Works on 315-448-CITY, 315-448-2489, and outside the district to the town or village, usually its DPW. Properties not on public sewer are told to contact a licensed plumber or service expert.
